Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Two 15 Ventures, LLC, the company that operates the Dovie service at hellodovie.com ("Dovie," "we," "us," or "our") governing your access to and use of our website, mobile and web application, and daily check-in service by text message and phone call (together, the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements and that the information you provide is accurate.
2. The Service
Dovie sends scheduled daily check-in text messages and/or automated phone calls to a designated person (the "loved one") and notifies the people you designate (the "care circle") based on responses. Features, schedules, and plans are described on our website and within the app and may change over time.
3. Your account
You are responsible for the information you provide, for maintaining the confidentiality of your login credentials, and for all activity under your account. Notify us promptly of any unauthorized use. Keep your contact details and your loved one's and care circle's details accurate and current.
4. Messaging consent and your responsibilities (SMS & calls)
The Service relies on text messages and automated calls delivered through our communications provider, Twilio. By using the Service, you agree to the following:
- Consent is required. You will obtain prior express consent from each person before enrolling their phone number to receive check-ins or notifications. By adding a loved one or care circle member, you represent and warrant that you have their permission to enroll their number.
- Recurring messages. Enrolled recipients will receive recurring automated check-in and notification messages and/or calls. Message frequency depends on the schedule configured.
- Rates. Message and data rates may apply. Consent to receive messages is not a condition of purchasing any product or service.
- Opt-out and help. Recipients may reply STOP to any text to stop messages at any time, and HELP for help. We honor opt-out requests promptly.
- Lawful use. You will use the Service only for its intended purpose and in compliance with all applicable laws, including the Telephone Consumer Protection Act (TCPA), carrier requirements, and messaging regulations (including A2P 10DLC rules). You will not use the Service to send unsolicited, harassing, unlawful, or deceptive messages, or to contact anyone who has not consented.
We may suspend or terminate access if we believe messages are being sent without proper consent or in violation of these Terms or applicable law. We do not sell or share recipients' phone numbers or opt-in data with third parties for their own marketing.
5. Not medical, emergency, or monitoring advice
Dovie does not provide medical advice and is not a medical, monitoring, or emergency-response service. Medication reminders and similar features are simple prompts and are not a substitute for professional medical care. You are responsible for arranging appropriate care and emergency plans for your loved one.
6. Service availability and delivery
We work to deliver check-ins reliably, but the Service depends on third parties and networks (including phone carriers and Twilio) that we do not control. We do not guarantee that every message or call will be delivered, received, or delivered on time, or that the Service will be uninterrupted or error-free. You should not rely on the Service as your only means of ensuring a person's safety.
7. Payment, trials, and cancellation
- Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment provider, Stripe, until cancelled.
- Free trials convert to a paid subscription unless cancelled before the trial ends, as described at sign-up.
- You can cancel at any time; cancellation stops future renewals. Except where required by law, payments are non-refundable for the current billing period.
- Prices and plan features may change; we will provide notice of material changes as required.
8. Acceptable use
You agree not to misuse the Service, including by: violating any law or third party's rights; enrolling numbers without consent; attempting to disrupt or gain unauthorized access to the Service; reverse-engineering the Service; or using it to harass, abuse, or harm anyone.
9. Intellectual property
The Service, including its content, branding, and software, is owned by Dovie or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable right to use the Service for its intended purpose. You may not copy, modify, or distribute it except as permitted.
10. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
11. Limitation of liability
To the fullest extent permitted by law, Dovie and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from missed, delayed, or undelivered messages or calls, or from any failure to detect or respond to an event. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the 12 months before the claim.
12. Indemnification
You agree to indemnify and hold harmless Dovie from claims, losses, and expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law, including any claim that you enrolled a phone number without proper consent.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or others. Provisions that by their nature should survive termination will survive.
14. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located in that jurisdiction, unless applicable law provides otherwise.
15. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
